AGS intervenes when your company is subject to insolvency proceedings (judicial safeguard, reorganisation or liquidation). Under the conditions defined by law, it ensures that the sums due under your employment contract are paid if the employer is unable to pay them.
In the course of the proceedings, the judicial representative will request AGS to intervene by drawing up a statement of unpaid sums.Certain conditions must be met in order for AGS to intervene.
The insolvency proceedings must be opened by the court and the sums due must be recorded by the judicial representative in a statement. This statement is then validated by the insolvency judge.
AGS then pays the funds to the judicial representative within 48 hours, on average.
